摘要
由于受到农村内部和外部多重利益诉求的影响,农村土地问题极易引起纠纷。
农村土地纠纷类型繁多,在不同历史时期和不同区域,受诸多因素的影响,有不
同的表现形式,当前最突出的是农村土地承包经营纠纷。农村土地承包经营纠纷
成因复杂,有深刻的社会根源。既有观念层面的,也有制度层面和操作层面的;
既有直接的经济利益冲突,也有深层次的体制性矛盾。农村土地承包经营纠纷呈
现出多层面多向度的特征。把握这些特征对于构建有效的纠纷解决机制具有重要
的启发意义。我国农村土地承包经营纠纷仲裁制度在解决土地承包经营纠纷中有
其优越性,但也存在一些不足。
本文首先对我国农村土地承包经营权的一般理论进行了分析,包括农村土地
承包经营权的概念、法律属性以及纠纷产生的原因,种类和特征;接着对农村土
地承包经营纠纷仲裁的法律属性进行了界定,比较了它与相关仲裁的区别,优势
以及它的基本原则;再接着对土地承包经营纠纷仲裁的制度现状进行了分析,主
要对制度本身和制度在实施中存在问题的原因进行了阐述;最后提出了若干完善
农村土地承包经营纠纷仲裁制度的对策。综上所述,希望论文能够对完善现阶段
农村土地承包经营仲裁制度具有一定的借鉴意义。

Abstract
As we know, the rural land issue is a plex social issue, because of
internal and external factors. It is easy to form rural land disputes and is difficult to
resolve. It has different forms in different periods. The current dispute is the most
prominent agricultural land dispute. The agricultural land dispute plex causes,
which have profound social roots. The reasons depend on the concept level, the system
and operational level. It contains not only direct financial conflict of interest, but also a
system of deep-level conflict. Diversification of agricultural land shows the
characteristics of disputes. If grasping the characteristics of the rural land contract
disputes, it is useful of improving the favorable arbitration. Arbitration of rural land
contract system is a little bit and disadvantages.
Firstly, it introduces the rural land contracting of a theoretical analysis, which
involves its concept , the legal property,the causes ,the types and characteristics;
Secondly, on the basis of the previous section, it defines the rural land contracting
dispute arbitration system, then pares the differences between the rural land
contract disputes arbitration and other arbitration systems, the benefits and basic
