文档介绍：毒品犯罪案件证据研究【内容摘要】: 针对毒品犯罪案件证据在调查收集、审查判断等方碰存在的问题,对其产生的原因及危害进行分析并对审查判断的具体方法进行论述。首先,对毒品犯罪案件的特点进行分析,认为毒品犯罪案件具有充分的预谋性、高度的隐秘性、作案时间长、地域跨度广、犯罪行为具有流动性、无直接被害人、、立功多等十个特点,而毒品案件证据则表现为:证据种类少、直接证据少、间接证据难以形成证据锁链、一些据以破案的证据难以在法庭上使用、靠言词证据定案的案件多、证据中出现“一对~”的情况多等特点。其次,对毒品犯罪案件中常用的查获毒品笔录、被告人供述和辩解、毒品物证及其他证据,在调查收集中存在的形式不合法、程序不公正、方法不得当、内容不完整等问题进行分析归纳,指出产生的原因及危害,提出应加以规范和完善的内容和方法。第三,对毒品案件中常用的查获毒品笔录、被告人供述和辩解、证人证言、毒品物证等证据审查判断的方法、内容和重点进行分析归纳,特别对证人证言审查判断做了深入的分析。同时,对全案证据综合审查判断过程中经常遇到的,对主观明知的审查判断、对“一对一”证据的审查判断、对证明毒品犯罪行为性质证据的审查判断等问题,提出了自己的看法。最后,指出在惩治毒品犯罪过程中,无论是调查收集证据,还是审查判断证据,都必须严格依照《刑事诉讼法》规定的原则、方法、内容进行,不能为了目的『F当性而违背合法性,只有在法律的轨道内办案,爿经得起历史的检验、社会的检验,也爿能最终控制毒品滥用和毒品犯罪。【关键词】毒品犯罪证据特点调查收集审查判断 Research on evidences ofdrug crime cases [Abstract】: Aiming atinvestigation and collection oftheevidences ofthedrug crime cases,and of judging and trying legal cases,analyze the causes and harmfulness and discuss specific methods ofexamination andjudgment.
