【中文摘要】近年来,我国经济社会发展不断加快,不动产交易在社会主义市场经济秩序中有日渐上升的趋势,而相应的产生了因不动产登记错误导致的诸多赔偿问题。目前,由于我国在不动产登记方面的法律法规还不够健全,这在一定程度上使得不动产交易安全受到了极大的影响。撰写本文的主要是,对不动产登记错误的赔偿责任问题从理论与实践的层面上进行深入的分析和探讨,从而提出关于不动产登记错误赔偿责任如何得以具体实现的一些建议,以此来促进我国关于不动产登记立法上的完善。本文主要撰写了五个方面的内容:第一方面是不动产登记错误的概念与具体体现。其首先分析了关于不动产登记错误概念界定的三种学说,最终得出对不动产登记错误概念界定得较为全面和准确的应为折中说,也最符合我国的实际。其次介绍了不动产登记错误的几种具体体现。第二方面是不动产登记错误产生的原因与损害后果。其首先对不动产登记错误产生的原因进行了深入的分析;而后对不动产登记错误产生的损害后果进行了阐述,即使登记错误将使得当事人受到物质上的损失,使善意第三人因信赖公示而遭受信赖利益的损失,导致房地产市场秩序混乱等。第三方面是不动产登记错误赔偿责任性质分析。其首先对不动产登记行为的性质进行了分析,认定不动产登记实际上是一种民事法律行为;其次对不动产登记错误赔偿责任的性质进行了阐述,认为不动产登记错误赔偿责任应是一种民事侵权责任。第四方面是不动产登记机构的审查义务分析。其通过上面对不动产登记行为与不动产登记错误赔偿责任的性质的分析,对不动产登记机构的审查义务进行了阐述,从而得出我国《物权法》采取的审查模式是以形式审查为主、实质审查为辅。第五方面是不动产登记错误赔偿责任的具体实现。该部分首先介绍了登记机构赔偿责任的范围,分析了具体赔偿中的赔偿项目及赔偿数额;而后分析了登记错误赔偿资金来源,提出了建立以国家财政出资承担为主、以不动产登记机构设立专门的赔偿基金为辅、同时兼顾保险机构负担一部分费用的赔偿金制度;最后,对登记机构如何行使追偿权提出了设想。
