根据国务院各部委的“三定”方案,目前我国反垄断法由三个部门分掌大权。商务
部负责经营者集中的审查,发展与改革委员会负责与价格垄断有关的反垄断执法,而国
家工商总局则负责价格垄断以外的“垄断协议”、“滥用市场支配地位”以及“滥用行
政权力排除限制竞争”的执法,可以说承担了大部分的反垄断职责。
本文立足《反垄断法》出台后工商行政管理机关反垄断执法问题的研究,分析了工
商行政管理机关反垄断执法工作的现实情况,对工商行政管理机关今后在反垄断执法工
作当中可能出现的问题进行了分析,并在此基础之上就如何完善工商行政管理机关的反
垄断执法工作提出了一些建议。
本文除引言外分四章。
第一章在回顾了工商行政管理机关竞争执法历史的基础之上,分析了在《反垄断法》
出台之后工商行政管理机关竞争执法的地位和作用。
第二章工商行政管理机关反垄断执法的职责。这一部分主要围绕工商行政管理机关
反垄断执法对滥用市场支配地位的规制、对垄断协议的规制、对行政垄断的规制,以及
工商行政管理机关反垄断执法与打击公用企业垄断等几个方面的问题展开。
第三章工商行政管理机关反垄断执法工作中面临的问题。在这一部分中对工商行政
管理部门在反垄断执法工作中的内部协调问题、外部协调问题、执法的局限性以及如何
与司法衔接等问题进行了阐述。
第四章完善工商行政管理机关反垄断执法工作的设想。在前文的基础之上针对新的
执法环境,对如何完善工商行政管理机关的反垄断执法提出了几点建议。

Abstract
With the fixed quota system shaped by Ministries missions of the State Council,
currently the state’s antitrust law was implemented by three departments respectively.
Commerce Department is responsible for concentration of business operator examination,
National Development and mission takes charge of antitrust enforcement
relating to price fixing, while State Administration of Industry merce is in charge of
the enforcement of monopoly agreements, abuse of joint dominant position petition
restriction caused by administration power abuse. It can be seen that the State Administration
of Industry merce undertakes the most antitrust obligation.
This article focuses on the enforcement problem of industrial mercial
administration after the promulgation of antitrust law, analyzing the current state of antitrust
enforcement and the problem which may occur in future antitrust enforcement; besides, the
author makes some suggestions on how to perfect the antitrust enforcement of industrial and
commercial administration.
