枉法仲裁罪的犯罪构成研究
摘要
《刑法修正案(六)》第二十条规定了依法承担仲裁职责的人员
的刑事责任,司法解释称本罪为“枉法仲裁罪”。确立“枉法仲裁罪”
增强了司法对仲裁的控制,可以有效地预防和惩罚仲裁中出现的枉法
行为,但本罪的条文文义简单,还存在着较大的不确定性和灰色解释
空间,并且由于是一个新罪,尚未有相关司法解释和立法解释对此作
出详细说明,因此有必要对该罪的犯罪构成进行详细的解剖,以指导
实践。
本文采用传统的犯罪构成研究方法,从客体、客观方面、主体、
主观方面对枉法仲裁罪的构成要件及其中的一些疑难问题进行一一
辨析和界定。首先分析了枉法仲裁罪的客体,认为枉法仲裁罪的客体
包含了仲裁委员会的正常职能活动及仲裁当事人的合法权益;其次通
过对仲裁活动范围的界定、对违背事实和法律的辨析、对枉法调解行
为的定性及对情节严重标准的认定,展开了对枉法仲裁罪客观方面的
分析;然后从一般性情形和特殊情形两个方面对枉法仲裁罪主体中出
现的疑难问题进行了解析;最后对枉法仲裁罪主观故意的内容和判断
标准展开了论述。

RESEARCH ON THE CONSTITUTE OF
LAW-BENDING ARBITRATION CRIME
ABSTRACT
Article 20 in Amendment VI to the Criminal Act of the People’s
Republic of China has regulated the criminal legal responsibility of the
people who assume the arbitrational liability. It is called "bending the law
in arbitration" in the judicial interpretations. Established this crime can
buildup the judicial control of arbitration, and prevent or punish the
bending doings in arbitrating effectively. However, the provisions of the
text of the crime are too simple, and there are still large uncertainties. As
it is a new crime, there is no relevant legislation and judicial
interpretation to explain this in detail, it is necessary to analyze the crime
constitutes to guide practice.
This paper adopts the traditional crime constitute research methods,
from the four aspect of the object, objective, the main body and
subjective to define and analyze the difficult problems of this crime. First
of all, the paper analyzes the object of the crime of law-bending
arbitration, and concludes that the objective is the normal functions of the
mittee and the legitimate rights and interests of the
