论检察机关提起公诉的证明标准
摘要：我国刑事诉讼法关于证据的规定比较简单，提起公诉的证明标准与法院判决的定
罪标准在表述上几乎一致，证明标准均是“事实清楚，证据确实、充分”，即检察机关
掌握的证明标准与法院判决掌握的标准同一，且规定得比较抽象、概括，在司法实践中
比较难以把握和操作。由于检察机关提起公诉的证明标准过高，且标准单一，从而导致
司法实践中检察机关控制和追诉某些犯罪超出了所能。本文通过评析检察机关提起公诉
的证明标准，并与国外相关做法相比较，认为提起公诉的证明标准应区别于法院判决的
证明标准。根据司法实践经验及借鉴国外相关经验，检察机关提起公诉的证明标准应确
定为：提起公诉的证明标准应低于定罪量刑的标准，且不再应以客观真实为标准，以确
保准确有效地执行法律。

Abstract: The our country code of criminal court provision concerning proof is more simple,
the proof standard that indict is in accordance with the court judicatory sentence the standard

court to control same, and provision comparison abstract, generalize, in judicatory practice
