网络环境下著作权的合理使用研究

论文摘要

合理使用制度在著作权基础理论中的地位十分重要。在过去,传
统合理使用制度起到了适当协调著作权人利益与社会公共利益之间
的矛盾,使得保护著作权人的专有权与资源的社会性这两方面和谐的
共存于著作权法律之中。然而,网络技术的飞速发展对传统著作权合
理使用制度造成了极大的冲击,使制度中原有的平衡各方利益的机制
失灵。因此,我们必须深入研究合理使用制度理论,构建出一套适合
当代情势变化发展的利益平衡机制,这对于完善我国网络环境下的著
作权法律规范,促进社会发展,是非常必要的。本文以数字网络环境
下合理使用的理论基础及具体制度表现为切入点,从合理使用制度的
历史和现状着手,分析了合理使用制度设立的最终目标及其使命。进
而从网络环境对著作权合理使用制度的冲击角度,对网络环境下著作
权以及传统的合理使用制度呈现出的新情况、新特点进行了探讨,得
出有限度的扩大合理使用制度的范围才能适应数字网络环境下的新
情况的结论。同时,还就我国网络环境下的合理使用制度的完善提出
了一些建议和意见。
全文分为四章。第一章介绍了合理使用制度的历史和现状,强调
合理使用制度从产生伊始就承担利益平衡的使命;第二章分析了数字
网络环境给著作权法带来的巨大变革以及对传统的合理使用制度的
冲击;第三章着重对网络环境下合理使用制度的基本理论问题进行了
深入剖析,分析了学界对于网络环境下合理使用制度完善的理论基
础、不同观点及价值体系;第四章是关于完善我国网络环境下合理使
用制度重构的建议,包括立法建议、技术措施与合理使用制度的协调
和完善合理使用制度的配套措施。笔者的观点为,我衡各方利益的目标,就应该有限度的扩大网络
环境下合理使用制度的使用范围。

Abstract

Fair Use takes place a crucial part in the fundamental
theories of copyright law. In the past, traditional system of
Fair Use well adjusted the interest confliction between
copyright owners and the public, enhancing the copyright
owner’s exclusive rights protection and publication of
resources peacefully remained in the copyright law. However,
rapid progress work technology crashes the traditional
Fair Use system by unbalancing the former separate interests
of each party. Therefore, it is necessary to construct a new
interest balance system to adjust this temporary environment
by adopting deep researches on Fair Use theories. It is also
of good help for maturity our copyright law in the cyber
environment to ensure the social development. This
