摘要:广告在经济发展中有着重要的宣传作用。在经济竞争的今天,各种各样虚假的广告充 斥于营业交易中,使竞争者和消费者的利益受到损害威胁。在呼唤诚信的今天,对虚假广告的治理 是刻不容缓的,因此从法律的角度对虚假广告的治理进行论述。首先对虚假广告的概念、类型及特 征进行分析论述,列举了虚假广告的原因及危害;其次又对虚假广告的法律责任进行论述,最后又 对虚假广告的法律治理措施进行论述,这方面主要立法措施和司法措施的角度提出对虚假广告的进 行法律治理的具体措施。

On the legal control of false advertisement

Abstract: As we know, the false advertisement generally exist in the current society, not merely do harm to consumers9 legitimate right and interests, caused the harm to the market management order legal operators, right and interests too at the same time. Today, call sincerely, the structure to the false advertisement is very urgent, so this text stands on the angle of the law describing the structure of the false advertisement. Originally in the article, I analyze and describe the false advertisement's concept, types and the legal characteristic, and enumerate the harm and production reasons of the false advertisement. Secondly I analyze and describe the false advertisement's legal responsibility too, in the end how to it correctly to describe the legal measures to the false advertisement, primarily include legislation measures and judicial measures.
