人民币国际化的法律问题

论文摘要
在全球金融危机下，越来越多的国家认识到改革以美元为主
导的国际货币体系已迫在眉睫。多元化的国际货币体系是当前危
机形势下的理性选择。作为一个日益强大的经济体的法定货币，
人民币应在国际货币体系中扮演更为重要的角色。这既是其它国
家摆脱美元束缚的需要，也符合中国自身的经济、政治利益。因
此人民币国际化存在着必要性。人民币可以在借鉴其它国际货币
成功经验、吸收其它国际货币教训的基础上，寻找一条合适的人
民币国际化路径。然而，人民币国际化还面临着许多问题，例如
人民币资本项目下还存在着较为严格的外汇管制，人民币汇率的
市场化程度不高，人民币资产投资工具较少等。人民币要实现国
际化，必须要完成对内对外两方面的改革。不管是对内的金融改
革，还是对外人民币资产投资工具的推广，相应的制度推进是必
不可少的。
因此，本文主要通过分析人民币国际化进程中所涉及的一系
列法律问题，进而将这些法律问题分为人民币国际化的国内法问
题和人民币国际化的国际法问题两个部分，以期寻找一套适合人
民币国际化的法制框架。在人民币国际化的国内法问题中，通过
对人民币经常项目、人民币资本项目和人民币汇率制度相关法律
制度的分析，提出立法完善措施逐步取消外汇管制。在人民币国
际化的国际法问题中，主要分析通过人民币区域化和人民币离岸
金融市场使人民币逐渐对外开放，进而走出国门，成为真正的国
际货币。

Abstract
In the global financial crisis, which spread from sub—prime
crises in United States, many countries realized clearly that it is time
for they to reform the international monetary system which is based on
dollars. In crisis, diversified international monetary system is the
rational choice. As one of world′s greatest economies, RMB should
play an important role in the new international monetary system. It′s
not only the need for many countries to get rid of the shackles of
dollars, but also for the sake of our economy and politic. So it′s
necessary to internationalize RMB. We should find an appropriate
path to internationalize RMB on the basis of successful experience
and failures from other international currencies. However, there are
still so many problems in our financial system. For example, the
foreign exchange control of capital account is strict, the extend of
marketization of exchange rate is not high, the investment tools of
RMB assets are scare. We need internal and external reformation. No
