文档介绍：我国劳动教养制度的改革与完善摘要劳动教养制度是具有中国特有的一种法律制度,它是根据1957年8 月1日全国人大常委会批准颁布的《关于劳动教养问题的决定》建立的, 作为中国法律制度的一个伟大创举,劳动教养制度在新中国发展的过程中为维护社会稳定,预防和减少违法犯罪,保障社会主义现代化建设方面做出了不可磨灭的贡献。但是,随着中国社会的发展变化,特别是改革开放以来中国法治化进程的加快,劳动教养制度本身具有的种种问题和弊端(如劳动教养制度的法律依据不充分、劳动教养制度与其它法律制度存在矛盾和冲突、劳动教养制度与国际人权公约相冲突、劳动教养制度体系内部存在矛盾和缺陷等问题)逐渐显现出来,已不适应当今中国日益开放、走向世界的政治、经济形势。近年来,理论界和实务界对劳动教养制度的改革提出了许多的方案,其间各有优势也各有缺陷,但始终都是对我们下一步推进劳动教养制度的改革和完善大有裨益的。在笔者看来,劳动教养制度虽然存在缺陷和不足,但仍具有自身存在的价值和意义,应该在推进法治、保障人权的基础上对其进行改革、使其完善,努力建立具有中国特色的法制化教育矫治制度。本文共分三个部分,引言部分引出问题,介绍了有关研究背景等。第一章对我国劳动教养制度进行简要概述,介绍我国劳动教养制度现状与面临的危机。第二章对我国劳动教养制度不同改革路径进行评析。第三章着重从基本原则、理念支撑和具体改革措施等提出了改革我国劳动教养制度的对策建议以及就完善我国劳动教养制度展开思考。希望通过本文的研究总结,能够提出一些较具可行性与操作性的对策建议,供有关部门作为决策咨询和参考,使经过改革后的劳动教养制度能更好地服务于我国的社会主义现代化建设。关键词:劳动教养制度,比较分析,改革,完善 RERORM AND PERFECTION OF CHINA REEDUCATION THROUGH PENAL LABORSYSTEM ABSTRACT Reeducation through penal labor system is a legal system with Chinese characteristic , which was established on《Decision regarding to questions of reeducation through labor》permitted and issued by the NPC mittee on August 31, 1957. As a famous initiative of Chinese legal system, it has been making indelible contributions to maintaining social order, preventing and decreasing illegal activities and crimes, and protecting the construction of socialism modernization from its establishment. But along with great developments and changes of China, especially with prompt of Chinese legalization process since reform and opening-up , sorts of problems and disadvantages (such as inadequate legal foundation、contradiction with other legal systems、conflict with International Covenants of Human Rights、 internal contradiction and ings, etc.)inhered in reeducation through labor system increasingly appear , which does not adapt to current politics and economy situation of more and more opening-up.
