摘要
在我国法治进程不断推进的今天,劳动教养制度现在已经成为我国社会奔向法
治社会的道路上最大的障碍。近年来立法机构和学术界为劳动教养制度的问题投入
了大量的精力,但是目前看来所取得的成效却是十分微小的,劳动教养制度的改革
和立法的方案还是迟迟不能推出。通过本文对我国已实行 50 多年的劳动教养制度的
历史发展和现状的考察,我们不难看出其当前存在的主要问题,从而进一步探讨劳
动教养制度改革措施,研究劳动教养制度的未来走向。笔者认为迫切需要对劳动教
养制度进行较大幅度的改革,文中提出以全国人大立法的程序产生一部新的治安法
律,称其为《严重违法行为教育矫治法》,以取代当前的劳动教养制度,从而全面
地加速我国的法治化进程,使我国司法制度更好地与世界司法制度和司法惯例接
轨。
本文本论部分共分为四章,第一章劳动教养制度概述,主要是论述劳动教养制
度的概念、性质、合理性和作用;第二章是劳动教养制度的产生与发展,主要分四
个阶段论述了劳动教养制度的发展历程和各阶段的主要立法成果;第三章是劳动教
养制度的现实状况,主要是从实体和程序两个角度对现行的劳动教养制度进行了细
致考察,找出了其中存在的问题;第四章是劳动教养制度的改革与完善建议,主要
论述了笔者对于劳动教养改革问题的意见和对《严重违法行为教育矫治法》的立法
建议。

Abstract
Today, with the process of rule of law improved in our country, reeducation through
labor system (RTLS) has now e the biggest block in our society to the rule of law.
In recent years, a lot of energy has been invested to the problem of RTLS by the
legislative bodies and the academia, but it seems that the achievements are not so
significant, so the legislation and reformation delay. This article analyses RTLS and finds
the main defects of it, thus the author thinks it is necessary to reform RTLS and suggests
the national people’s congress should produce a new security law ‘serious offence law’ to
take the place of the present law, so as to speed the legalization progress of our country
and make our judicial system integrate better with that of the world.
This article is divided into four chapters. The first chapter is the general introduction
to the concept, characteristics of RTLS. The second chapter deals with history and
discusses the four phases of development and legislation. The third chapter concerns the
realistic condition and main defects of RTLS, mainly investigates RTLS carefully from
substantive and procedural angles, and finds out the inadequacies. The fourth chapter is
about the reformation of RTLS, the author gives his own views on reformation and
legislative suggestions
