文档介绍:. 页眉. 页脚.. 本科生毕业论文商品房买卖预约合同的法律责任——龚海波与州金龙房地产开发公司商品房买卖预约合同纠纷判决评析姓名付文超学号 20094100304 专业法学指导教师李永安 2013 年5月 19 日. 页眉. 页脚.. 摘要: 一般认为,预约合同是约定将来订立一定合同之合同。预约合同制度作为大陆法系各国存在已久的一项法律制度,自十九世纪初在法国民法典确立开始,就引起了各国的广泛关注,并被纳入到各自的法律体系之中。预约合同作为规范合同缔结程序的一项制度,很好地适应了市场交易和商业发展的需求,然而我国目前对预约合同制度的研究成果并不多。本文通过合理利用网络数据库与图书馆图书资料查找相关资料,合理利用演绎推理、价值分析、归纳、比较等方法对商品房买卖预约合同进行了较为系统的研究。商品房买卖是一项涉及社会公众利益的交易,在当前我国关于预约合同的法律规定相对缺失的情况下,研究商品房买卖预约合同案件的审理,具有特别的理论意义、现实意义和社会意义。关键词: 预约合同;法律效力;诚实信用;商品房 Abstract : Generally, the appointment contract isa contract concluded future contract. The appointment contract system as the countries of the continental law system isa legal system for a long time, since the beginning of the eenth Century in the French civil code establishment, has attracted wide attention, and has been incorporated into the legal system respectively. A system of appointment contract asa standard contract procedures, well adapted to the market and business development needs, but the current research results on the appointment contract system is not much. In this paper, through the rational use work database and library books to find information, reasonable use of deductive reasoning, value analysis, induction, comparison and other methods, the systematical research on precontract. The sale mercial housing isa public interest in the transaction, the relative lack of current our country about the booking contract law, the sale mercial housing contract cases, has special theoretical significance, practical significance and the social significance.
