适用社区矫正调查评估办法
（征求意见稿）
第一条【目的依据】为了规范适用社区矫正调查评估工作，根据刑法、刑事诉讼法和社区矫正有关规定，制定本办法。
第二条【概念界定】依法适用或者提请适用社区矫正的机关，应当核实被告人、犯罪嫌疑人、罪犯的居住地，考虑其适用社区矫正对所居住社区的影响，可以委托居住地县级司法行政机关对其居所情况、家庭和社会关系、一贯表现、犯罪行为的影响等进行调查，提出评估意见。
第三条【工作要求】接受委托的县级司法行政机关应当及时组织调查，依法全面了解情况，客观公正做出评估，在规定的期限内将调查评估意见提交委托机关。
第四条【委托情形】对于下列情形，人民法院、人民检察院、公安机关、监狱可以委托县级司法行政机关进行调查评估：
（一）人民检察院拟对犯罪嫌疑人提出适用社区矫正的量刑建议的。
（二）人民法院拟对被告人判处管制、宣告缓刑或者决定暂予监外执行的，但是人民检察院已经委托司法行政机关进行调查评估的除外。

（三）人民法院拟对被告人适用禁止令的。
（四）监狱、看守所拟对罪犯提请暂予监外执行的。
监狱、看守所拟对罪犯提请假释的，应当委托县级司法行政机关进行调查评估。
第五条【委托程序】人民法院、人民检察院、监狱、看守所委托调查评估时，应当向被告人、犯罪嫌疑人、罪犯居住地县级司法行政机关发出调查评估委托函，并附带下列材料：
（一）人民法院委托时，应当附带起诉书或者自诉状。
（二）人民检察院委托时，应当附带起诉意见书。
（三）监狱、看守所委托时，应当附带终审法院的刑事判决书、执行通知书、历次减刑裁定书以及罪犯在服刑期间的表现情况。
调查评估委托函应当包括被告人、犯罪嫌疑人、罪犯的XX、住址、案由以及委托机关联系人和联系方式等内容。
委托机关发出调查评估委托函，应当派员送达或者采取邮政特快专递等方式送达，
