摘要
近年来,我国电子商务呈现快速发展的趋势,其贸易额也连创历史新高,但是因为国内电子商务信用体系的建设尚不完善,消费者合法权益受到侵犯等现象时有发生。我国电子商务从 1995—1996年的概念引入、 1999年至今的社会各界自主地广泛应用,到2005年4月1日我国信息化首部法律《电子签名法》的正式颁布实施和相关配套规范文件的相继出台,可以说我国电子商务信用管理的法制体系建设已经取得了很大的突破。但总的来说,整个法制体系仍不够完善,造成了网上交易各方存在信用博弈心理,导致了整个电子商务行业巨大的信用风险。加快电子商务发展,将会促进我国经济增长方式转变,提高国民经济增长的效率和质量,形成国民经济发展的新动力,实现经济社会全面、协调、可持续发展。同时可以促进商品和各种要素的流动,降低交易成本,形成统一完善的市场,更好地实现市场对各种资源的基础性配置作用。提高我国参与国际竞争和在全球范围内配置资源的能力,提升我国经济的国际地位。

Our country merce from 1995-1996, introduces the concept of 1999 to the present society from all walks of life independently widely used, to April 1, 2005 the informatization of our first law of electronic signatures in law the official promulgation implementation and related standard file have issued, it can be said that China's merce credit management system, the construction of legal system has been a big breakthrough. But overall, the whole legal system is still not perfect, caused the online trading parties exist credit game psychology, causes the entire electronic business industry huge credit risk. To speed up the merce development, will promote the economic growth mode, improving national economic growth, form the efficiency and quality of the development of national economy, the social economy in a prehensive, coordinated and sustainable development. And to promote modity and various elements of the flow, lower transaction costs, form a unified perfect market, better achieve market for all types of the basic resources allocation role. Improve China to participate in petition in the global scope and allocation of resources, improve the ability of the economy in our country international status.
