The thirdpart classifies the good faithduties intheinsurance law of andanalyzes author alsoputs forward some advice toperfect it. The fourth partmainly discusses theproblems existed nowadays and puts forward some advice. Key Words:Good faithprinciple Insurance law Application 论诚实信用原则在保险法中的适用前言随着我国保险业的不断发展,保险深度和保险密度的不断加大,,, 保险合同关系人和保险合同辅助人是否履行了其诚实信用义务。保险合同是最大诚实信用合同,所以研究保险合同当事人,, 也可以为解决保险纠纷提供法律依据. 保险法是商法的重要内容之一。在保险业较为发达的国家,,而且专门研究保险法的学者较多,,由于保险业起步较晚,保险法的研究相对滞后。我圉研究保险法的学者较少,即使有的学者对保险法有所关注,也并未把保险法作为自己主要的研究对象,因而研究成果也较少,现行的许多保险法著作或论文主要停留在对现行保险法的阐述和解释层面。对保险法律研究的滞后导致了我国的保险法律法规不够完善,致使实务中出现的许多问题无法得以解决。基于此, 本文作者在研究保险法时,对“保险合同是最大诚实信用合同”这一古老而又现实的命题发生了浓厚的兴趣并决定将“诚实信用原则在保险法中的适用”作为硕士论文选题。为了全面深入地阐述“诚实信用原则在保险法中的适用”,作者首先对诚实信用从道德和法律两个方面进行阐述,继而又从历史的角度论证了诚实信用原则在民商法中地位的确立,, 作者通过对现有资料的整理分析,论证了诚实信用原则在田外和我嗣台湾、,,作者从实践的角度论述了诚实信用原
