　　虽然私家侦探在我国存在广泛，但是对于私家侦探的法律地位，在我国现行法律并没有明确规定，与享有侦查权的国家机关（主要是公安机关）对比，可以看出我国对私家侦探的相关权利义务的立法空白。无论从私家侦探的权利还是义务来看，我国法律都没有对其作出明确的规定，关于私家侦探的法律规定可谓一片空白，这也导致了私家侦探在实际工作的开展中出现了许多问题。 
　　（三）我国私家侦探行业存在的问题 
　　近年来，随着经济的发展和矛盾纠纷的大量出现，私家侦探的市场需求在不断扩大，私家侦探行业的从业人员和业务范围也不断扩大。据统计，国内现有各种私家侦探机构约3700家，从业人员达2万多人。然而作为一种职业，“私家侦探”还未被我国法律所认可。由于缺乏必要门槛和有效监管，行业人员素质良莠不齐，导致该行业秩序混乱，出现了各种各样的问题。
