     （一）已取得市局（公司）对工程项目的立项批复；
     （二）有满足招标需要的施工图设计文件及技术资料，施工图设计文件已经市公司审查合格；
     （三）烟叶基础设施建设项目烟农自愿申请且已和烟农签订了协议。
（四）有关法律、法规、规章规定的其他条件。
第十二条  本行业内的施工招标原则上应采用公开招标方式。
因特殊情况确需邀请招标或直接发包的，必须按照有关规定报市公司批准后，发包人方可按邀请招标程序或承发包程序依法组织邀请招标或承发包活动。
 第十三条  应当施工招标的工程项目有下列情形之一的，经市局（公司）批准后，可以不招标。
（一）停建或者缓建后恢复建设，并且原承包人仍然具备承包能力的；
（二）为配合发挥整体效能所追加的主体加层工程或者追加投资额不超过原工程投资总额10%的附属小型工程，并且原承包人具备承包能力的；
（三）响应招标的潜在投标人或者投标人少于三个，经过再次招标仍然少于三个的；
（四）属于法律、法规、规章规定的其他情形的。 
 第十四条 依法应当公开招标的工程项目，发包人拟突破本办法第七条规定进行发包的，必须将发包方式、招标方式报市公司批准并抄送监理单位。
