行政法一词是在1893年才在美国的学术著作中首先出现，而在此前，美国行政法主要援引、接受英国的法律，通过法院对行政权的行使加以控制，主要形式是令状制度。1946年，美国国会通过联邦行政程序法，美国行政法有了一套规范的行政程序。美国行政法由国会、行政部门和法院共同制定，是由法律规范文件中所载的行政法律法规所构成的法律规范系统，其中包括了调整行政机构的组成、职权的规范和调整行政活动程序的规范及调整监督、制约行政权行使，为被管理的组织、个人提供权利保障和救济手段、途径。
