前款第（四）、（五）两项人员只适用于在乡、镇以下地区开业行医。
第九条有下列情形之一者，不得申请开业行医：
（一）全民所有制和集体所有制医疗机构的在职人员；
（二）因道德品质败坏或严重医疗过错，被开除公职或撤销从事医疗工作资格者；
（三）精神病患者及患有其他不适宜开业行医的疾病者。
第十条举办医疗机构必须具备下列基本条件：
（一）法人代表必须是具有一定管理经验的医疗专业技术人员。
（二）有与医疗业务范围相适应的诊断、治疗、抢救用医疗仪器设备和药品。
（三）有健全的规章制度。
（四）有与医疗机构业务范围相适应的医、护、药、技人员和病床数。
1．医院：
病床总数不少于二十张；医院建筑面积按每床不少于四十五平方米计算；至少有三名医师（中医院至少含二名中医师）、四名护士和一名药剂师（士）。三名医师中至少有一名具有主治医师以上职称。
2．门诊部：
至少有三名医师（中医门诊部至少含二名中医师，专科门诊部至少含二名专科医师）和四名护士。

3．联合医院：
病床总数不少于二十张；至少有四名医师、六名护士、二名药剂士、一名检验士、一名放射技士。
4．联合诊所：
至少有二名医师、三名护士（产科联合诊所一名护士、二名助产士、一名药剂士）。
5．卫生所、诊所：
至少有一名医师。
6．卫生站：
至少有一名医师（士）或乡村医生。
第十一条申请开办医疗机构的人员必须交验下列证件与材料：
（一）开业申请书；
（二）医疗机构组织章程及管理制度；
（三）毕业文凭或任职资格证书；
（四）个人履历、业务自传和有关证件；
（五）当地常住户口或暂住户口证；
（六）体格检查表；
（七）用房产权证书或租赁合约；
（八）银行资信证明或担保书。
第十二条医疗机构名称，不得任意冠以中国、中华、省、市、县等字样，个体开业行医名称写本人姓名并冠以技术职务。其所使用印章须
