第一条 为实施?中华人民共和国人口与方案生育法?〔以下简称?人口与方案生育法?〕，结合本省实际，制定本条例。
第二条 在本省行政区域内的国家机关、社会团体、企业事业单位和其他组织，居住在本省的以及户籍在本省而居住在省外的公民，必须遵守?人口与方案生育法?和本条例。
第三条 人口与方案生育工作，坚持宣传教育为主、避孕为主、经常性工作为主的方针，建立和完善依法管理、村〔居〕民自治、优质效劳、政策推动、综合治理的管理机制。
第四条 省、市、县〔含县级市、区，下同〕人民政府领导本行政区域内的人口与方案生育工作。
省、市、县方案生育行政部门负责本行政区域内的方案生育工作和与方案生育有关的人口工作；其他行政部门在各自职责范围内负责有关的人口与方案生育工作。
第五条 工会、共青团、妇联及方案生育协会等社会团体、企业事业单位和公民，应当协助人民政府开展人口与方案生育工作。

第六条 各级人民政府应当对在人口与方案生育工作中做出显著成绩的组织和个人给予奖励。
鼓励公民对人口与方案生育工作的监督，对举报违反人口与方案生育法律、法规行为并经查实的，由被举报人所在县人民政府给予奖励。
第二章 人口开展规划的制定与实施
第七条 县级以上人民政府依据?人口与方案生育法?编制本行政区域的年度人口开展方案和中、长期人口开展规划，根据人口开展方案和规划，制定人口与方案生育实施方案并组织实施。
第八条 县以上方案生育行政部门负责人口与方案生育实施方案的组织、协调、考核、评估等日常工作。
