( 三 ) 医疗机构在职、因病退职或者停薪留职的医务人员；
( 四 ) 发生二级以上医疗事故未满 5 年的医务人员；

( 六 ) 被吊销《医疗机构执业许可证》的医疗机构法定代表人或者主要负责人；
( 七 ) 省、自治区、直辖市政府卫生行政部门规定的其他情形。
有其中 ( 二 ) 至 ( 六 ) 项所列情形之一者，不得充任医疗机构的法定代表人或者负责人。
4 ．申请设置医疗机构不予批准的情形

申请设置医疗机构有下列情形之一的，县级以上地方卫生行政部门不予批准：
( 一 ) 不符合当地《医疗机构设置规划》；
( 二 ) 设置人不符合规定的条件；
( 三 ) 不能提供满足投资总额的资信证明；
( 四 ) 投资总额不能满足各项预算开支；
( 五 ) 医疗机构选址不合理；
( 六 ) 污水、污物、粪便处理方案不合理；
( 七 ) 省、自治区、直辖市卫生行政部门规定的其他情形。
二、 医疗机构执业登记与校验
1 ．医疗机构执业登记
根据《医疗机构管理条例》，医疗机构执业，必须由批准其设置的人民政府卫生行政部门办理登记，领取《医疗机构执业许可证》。国家统一规划设置的医疗机构的执业登记，由所在地的省、自治区、直辖市人民政府卫生行政部门办理。机关、企业和事业单位设置的为内部职工服务的门诊部、诊所、卫生所 ( 室 ) 的执业登记，由所在地的县级人民政府卫生行政部门办理。
县级以上地方人民政府卫生行政部门自受理执业登记申请之日起 45 日内，按照《医疗机构管理条例》规定的条件和规定的时限进行审查和实地考察、核实，并对有关执业人员进行消毒、隔离和无菌操作等基本知识和技能的现场抽查考核。审核合格的，予以登记，发给《医疗机构执业许可证》；审核不合格的，将审核结果以书面形式通知申请人。
