第三，帮助和指导劳动者订立、履行劳动合同，并与用人单位建立集体协商机制。劳动合同法赋予工会帮助、指导劳动者与用人单位依法订立和履行劳动合同、维护劳动者合法权益的权利和职责。各级工会组织应当严格按照法律要求，切实承当起这一职责，保证劳动者能够在平等协商的根底上与用人单位订立劳动合同。
第四，在集体合同的订立过程中发挥应有的作用。工会要通过多种方式和途径，积极参与和指导集体合同的订立。对于那些已建立工会的企业，上级工会要培养企业工会进行集体协商的能力，使之在协商中准确充分地表达职工意愿；尚未建立工会的，上级工会要认真指导职工推举的协商代表，代表职工与企业进行平等协商。同时，要努力推动区域性行业性集体合同。劳动合同法明确了工会作为主体一方订立区域性行业性集体合同的法律地位，各级工会组织要抓住机遇，力促区域性行业性集体合同的扩展，更好地发挥其协调劳动关系的作用。
第五，监督用人单位依法履行劳动合同、集体合同，支持劳动者的仲裁和诉讼。依照劳动合同法的规定，工会应当依法维护劳动者的合法权益，对用人单位履行劳动合同、集体合同的情况进行监督。用人单位违反劳动法律、法规和劳动合同、集体合同的，我们会及时提出意见，要求他们予以纠正；劳动者申请仲裁、提起诉讼的，我们还要依法给予支持和帮助；用人单位单方解除劳动合同，违反法律、行政法规规定或者劳动合同约定的，我们要依法要求用人单位纠正，严格按法律办事。
