第三章 征税对象和征税范围的认定
第七条 房产税以房屋为征税对象，对构成房屋的财产征收房产税。
第八条 地方税务机关在认定纳税人的财产是否具备房屋标准时，应依照下列条件：
（一）有屋面和围护结构（有墙或两边有柱）；
（二）能够遮风避雨；
（三）可供人们在其中生产、经营、工作、学****娱乐、居住或储藏物资等。
对不具备上述条件，不构成房屋的财产，不征收房产税。
第九条 房产税在规定的范围内征收。其具体征税范围是：
（一） 城市，包括城市市区和郊区；
（二） 县城，指县人民政府所在地；
（三）建制镇，指镇人民政府所在地；

（四）工矿区。
城市、县城、建制镇、工矿区的具体征税范围，由省辖市人民政府划定。
第十条 对于征税对象和征税范围难以确定的，由省辖市地方税务局报经省地方税务局确认。
第四章 计税依据和税率的认定
第十一条 对房产税的计税依据，主管地方税务机关可按下列程序进行确定：
（一）房产的计税价值是指依照房产原值一次性减除30%后的余值，%。
（二）房产原值是指纳税人按照会计制度规定，在账簿“固定资产”科目中记载的房屋原价。
（三）房产原值应包括与房屋不可分割的土地及各种附属设备或一般不单独计算价值的配套设施。附属设备或配套设施具体包括下列内容：
、卫生、通风、照明、煤气、中央空调等设备；
，包括蒸气、压缩空气、石油、给水排水等管道及电力、电讯、电缆导线；
、升降机、过道、晒台等。
第十二条 属于房屋附属设备的管线，应按下列方法计算：
（一）水管、下水道、暖气管等从最近的探视井或三通管算起；
（二）电灯网、照明线从进线盒联接管算起。
第十三条 对于出现下列情况的，房产的计税价值由主管地方税务机关根据实际情况分别确定：
（一）纳税人未按会计制度规定在“固定资产”科目内记载房屋原价的，主管地方税务机关有权按规定核定其房产原值；
