摘要
仲裁,作为一种古老的民间纠纷解决方式,早在古希腊时代就有记载,但
仲裁制度的蓬勃兴起则是在人类社会进入世纪以后。我国的仲裁制度始于建
国初期,经过多年的发展,已成为我国司法制度的一个重要组成部分。但是,
从我国目前状况来看,仲裁制度还不够成熟和完善,《仲裁法》也亟待修改。在
我国加入的今天,随着世界贸易的全球化、自由化趋势不断加强,各国开
放程度的加深,立法、司法方面透明化的提高以及贸易法的统一趋势,将直接
导致我国仲裁案件数量激增;同时,在仲裁服务对外开放的要求下,外国仲裁
机构将有可能进入我国境内进行机构仲裁,甚至抢滩国内仲裁市场。因此,我
国仲裁必须作出相应变革以应对这些问题与挑战,发展我国的仲裁制度势在必
行。
仲裁制度是市场经济发展不可或缺的一项重要制度,这一点已被世界各国
的仲裁实践所证实。我国仲裁制度虽然经过发展取得很大成绩,但在仲裁机构、
仲裁协议、仲裁程序和仲裁监督等方面还存在不少问题。而只有解决好这些问
题,我国仲裁制度才能得以完善。

我国仲裁法律制度问题研究
Abstract
As an old way to solve the dispute among the people, arbitration is recorded in
ancient Greek era. But arbitration system get unprecedented developed after the
human society enters the 20th century. The arbitration system of our country starts in
the early days of country foundation. After it developed more than 50 years,
arbitration has already e an ponent of the judicial system of our
country. However, according to the present state of our country, arbitration is not
enough ripe plete. Arbitration law demands to be modified urgently. Today,
our country joins WTO and merce liberalizes progressively. Each country
opens further, Legislation and the administration of justice melt transparently one
after another. Relevant trade laws are convergent further too. All these will make the
quantity of our country arbitration to be increased sharply. At the same time,
arbitration serve have to be opened to the outside world after entering the WTO. The
foreign anization e to arbitrate in our country too, even
founding anization in our country. In this case, our country must make
the corresponding change to contend with it. It is necessary to develop the arbitration
system of our country.
Arbitration system is the indispensable system of economic development.
