摘 要
在中国广阔的的农村占据着极其重要的位置农村的稳定与否直接关系着整个民族的将来而农村的稳定在于土地之稳定。随着社会年轮的滚滚前进并伴随着第二三产业的迅速开展土地资源面临着新一轮的重新整合而土地承包经营权流转便在这整合挥着不可替代的作用。虽然我国现行法律虽然对土地承包经营权流转作了详细的规定我们我国现行土地承包经营权流转制度仍然存在许多缺乏主要表现为农村土地承包经营权转让过程中土地所有人的地位相矛盾、各流转方式之间内涵外延界定不清、流转方式的缺失、存在前后矛盾的立法主张等等。这些问题对农村经济的快速、安康开展以及农村的稳定产生了消极的作用应从明确土地所有人在农村土地承包经营权流转中的作用和角色、完善农村社会保障制度、农村救济制度等相关的制度等几个方面进展改善。
