行政程序说明理由制度研究
摘要
当前,我国有关行政程序的宏观研究已渐成体系,但在微观操作层面上的探讨尚处于起步阶段,而对行政行为说明理由这一行政执法领域的重要制度的研究则更显粗糙。说明理由制度是行政程序体现正义的必要条件之一,是保障程序理性的手段之一。研究行政行为说明理由制度并将之应用到实践中去,可以很好地控制行政权的行使,使之良性地运作,树立行政主体行政执法的权威,提高行政行为的可接受程度,从而最大限度的保护相对人的权利。行政行为说明理由制度通过授相对人以“利器”,可以达到制约行政权滥用之目的。因而,研究行政行为说明理由制度对我国现行行政法治建设具有极其重要的意义。
文章分为三个部分,第一部分从行政行为说明理由制度的一般理论入手,阐释了行政行为说明理由制度的内涵、功能等,为该制度的建构提供了理论支撑。第二部分概述了我国当前说明理由制度的现状,指出了其不足和原因。第三部分试图为我国建构一套完整的、具有可操作性的行政行为说明理由制度。包括我国行政行为说明理由制度的现状、说明理由的制度性缺陷、说明理由具体制度的建构。

Abstract
At present,the macroscopic study of the relevant administrative
procedure in our country has developed into a system gradually,but the micro study is still in the starting stage,especially the expressing reasons system of administrative act,which is a key system in the field of administrative enforcement,is rougher. Expressing reasons system is one of the prerequisites that administrative procedure embodies justice and one of the rational resorts in procedure. The study of expressing reasons system and its application in practice can control effectively the execution of administrative powers and cause it to function benignly so as to establish the authority of the administration subject’s administrative enforcement of law,improve acceptability of the administrative act and protect rights of the opposite party to the largest degree. Expressing reasons system can restrict abusage of administrative powers by vesting the opposite party with “a sharp weapon”. Therefore,the study of expressing reasons system of administrative act is significant for construction of modern administrative rule by law.
