论中国环境法正义价值的局限及其完善

摘要
环境问题是一个现代性问题,科学与经济的发展在带给人类福祉的同时导致
了自然环境的恶化,并且环境问题已然危及到人类的生存与发展,我们必须通过
相应的规范对人类行为进行约束,诸如道德、习俗与宗教,更为必要的是应当创
制完善的环境法直接引导人类的环境实践。中国自 20 世纪末颁布《环境法》以来,
虽然对环境保护起到了积极作用,但中国的环境问题并没有因此改观多少,我们
认为环境法本身的欠完善是一个重要原因,从根本上说,中国的环境法缺乏环境
哲学思想的指导,尤其缺乏环境伦理与环境正义思想的指导。因此,我们在本课
题中对中国环境法进行道德维度的反思,考察环境法的正义价值,并提出完善环
境法正义价值的应对策略。
在绪论中,主要介绍论文的选题依据与研究现状,并陈述课题的研究意义。
在第二章,主要梳理中国环境法的历史与现状,并考察中国环境法存在的问题。
在第三章,从正义视角考察中国环境法的价值,揭示中国环境法在正义价值上的
缺失,并探析正义价值缺失的原因。在第四章,主要考察中国环境法正义价值的
完善与实现,从价值取向与价值原则上完善环境法的正义理念,而从立法、执法
与守法维度实现环境法的正义价值。

ABSTRACT
Environmental issues is a problem of modernity, development on science and
economic bring human well-being but results in the deterioration of natural
environment,and environmental issues is threatening to human survival and
development, we must pass the appropriate standard constraints on human behavior
such as ethics, customs and religion, the more necessary that we should create a sound
environment law to guide human practice,since 20th century 90's,Chinese
environmental laws develop,includeing the structure and the number of environmental
law, However, China's environmental problems has not changed much,We consider that
an important reason is the law itself less developed, fundamentally speaking, China's
environmental laws are lack of environmental philosophy,especially the thinking of
environmental ethics and environmental justice,so we discuss China's environment
about moral dimension in this topic, and study the justice value of environmental
law,and bring up the countermeasures to improve justice value of environmental law.
In the introduction, we will introduce the dissertations and research, and state issues
of significance. In the second chapter,we talk about the sort of history and status on
Chinese environmental law,and examine the problems of Chinese environmental law.
