老年人精神赡养法律问题研究

摘要

中国正在进入老龄化社会,老年人的赡养和社会保障引起人们的广
泛关注,但是只关注老年人的物质赡养,忽视了老年人的精神赡养。目
前我国老年人精神赡养问题突出,出现了大量的围绕精神赡养的案例,
而我国法律仅强调赡养人履行经济上的给付以及保障义务,对于精神方
面的抚慰义务规定的比较模糊。重视精神赡养是社会发展的必然要求,
精神赡养的规定应当合乎我国社会发展的现实和趋势。本文的关注点就
是老年人的精神赡养问题。
本文在案例分析、调查问卷分析的基础上,总结当今社会老年人的
精神赡养的问题,并从中提出一些对精神赡养的法律构想。笔者认为精
神赡养问题虽然属于道德问题,但是可以纳入法律的调整范围,因为法律
调整的是最低层次的道德问题。精神赡养问题目前随着社会的发展,人
类文明的进步,应当属于最低层次的道德。本文明确了精神赡养的内涵,
界定了精神赡养的外延,提出精神赡养的具体内容、履行方式以及权利
救济方式。

THE STUDY ON THE LEGAL ISSUES OF THE ELDERLY
SPIRITUAL SUPPORT

ABSTRACT

China is turning into an aging society, the elderly support and social
security arise widespread concern, but just concerning of the elderly's
material maintenance, neglecting of their spiritual support. China’s
elderly spiritual support problems stand out. There have been a lot of
cases of the spiritual support. But the law only emphasizes the
maintenance of economic as well as the security obligations, for spiritual
support obligations paratively. Regarding the spiritual
support is an inevitable requirement for social development. It plays an
indispensable and important role at present. This paper concerns of the
spiritual support problems of the elderly.
In this paper, the author sums up the spiritual support problems of
the munity on the basis of case studies and analysis of the
questionnaire, and advance the legal concept of spiritual support. The
author believe that the spiritual support problems belong to the moral
issue, but it can be adjusted by law. Because the law is to adjust the
minimum level of morality, the spiritual support should belong to the

lowest level of morality with the current social development and progress
