——以上海市闸北区处理的申诉、举报案件为口径

摘要

本文以上海市工商行政管理局闸北分局处理的申诉、举报案件为
口径,对消费者权益保护工作的有效性展开分析。文中采集的样本包
括了 2004 至 2008 年度闸北区消费者申诉案件、群众举报案件的登记、
受理、查处的数据,以及在这五年间由消费者权益保护行政执法工作
所引发的行政复议与行政诉讼情况。通过研究发现:五年来,消费者
申诉案件的受案数不断递增,调解成功率保持在相对较高的水平,通
过申诉途径查处经营者违法行为的比例有所上升;工商机关基本建立
起畅通有效、立体化的群众举报受理平台,通过群众举报查处了一批
经济领域违法案件,但是对举报线索的立案率还有待提高,对大、要
案件的查办能力有待加强;同时,由消费者权益保护工作而引发的行
政复议与行政诉讼率始终保持在相对较低的水平。本文通过对数据的
分析得出工商闸北分局在消费者权益保护领域的工作总体有效的结
论。

——BASED ON THE APPEAL AND TIP-OFF CASES
OCCURRED IN ZHA BEI DISTRICT,SHANGHAI

ABSTRACT

In this paper we analyze the validity of customers’ right protection
according to the appeal and tip-off cases occurred in Zha Bei
District,Shanghai. The samples in the paper includes the registration,
disposal and investigation cases which appealed or reported by customers
in Zha Bei District from 2004 to 2008, administrative reconsideration and
administrative litigation resulted from customers’ right protection in these
5 years. We found that there were more and more appeal cases registered
and interceded with high ess rate. The proportion of illegal act which
checked through appeal was increased. Meanwhile, a series of violation
cases in economic field were investigated through the effective and
diverse tip-off platform which established by the Industry merce
Administration Authorities. On the other hand, we need increase the rate
of keep dossiers on tip-offs and enhance our check capacity on big and
important cases while we always maintain the relatively low rate of
administrative reconsideration and administrative litigation which result
from customers’ right protection. Based on these analysis data, we draw a
