摘要
军婚特殊保护法律制度是我国特有的法律制度,源自于我国的法律文化传统并在特
定的历史时期发挥了相应的作用,体现了其存在之价值。本文考察了中国军婚特殊保护
法律制度得以形成的历史背景及发展沿革,并阐释了破坏军婚罪的概念,对破坏军婚罪
的构成要件进行了分析,明确在现行刑法二百五十九条的规定下,与军人配偶长期通奸
的行为不构成本罪;破坏军人事实婚姻的行为应以本罪论处;而与有配偶的现役军人结
婚或同居的人不构成本罪。破坏军婚罪属于继续犯,本文区别了破坏军婚罪与重婚罪、
强奸罪等罪名的罪数关系。笔者建议对刑法第二百五十九条进行修改,增设与现役军人
配偶长期通奸行为为危害行为;明确现役军人的配偶可以成为本罪的主体,与有配偶的
现役军人结婚或者同居的人应成为本罪主体,以完善刑法对破坏军婚罪的规定。

Abstract
Military marriage protection legal system is China's unique legal system rootin our legal
cultural tradition and in the specific historical periods, the corresponding role play embodies
the value of its existence. This paper studies the Chinese legal system military marriage
special protection to of the historical background and development evolution, and explains the
concept of destruction, military marriage to destroy ponents of the military marriage
is analyzed in the current criminal law, clear 259 rules, and the military spouses long-term
adultery don't constitute this crime. Destroy the behavior of fact marriage soldiers should
punish crime. But with spouse a serviceman who married or cohabiting does not constitute a
crime. Damage military marriage belong to keep making, this paper is the difference military
marriage and destruction of bigamy, rape charges such as sin number relationship. The author
suggests to criminal law article 259 modified, add and serviceman spouse long-term adultery;
for dangerous act Clear serviceman spouse can e the subject of this crime has a spouse,
and a serviceman who married or cohabiting should e the main body, with the perfect
crime, criminal damage the provisions of military marriage.

引言
军婚特殊保护法律制度是我国特有的一项法律制度,国外在立法上对军人的婚姻关
系没有特别保护的规定,因而也没有相关的理论研究。我国有关军婚特殊保护法律制度
的研究也处于初探阶段,还没有形成体系化的理论成果。但是,我国法律一直沿袭着对
军人的婚姻给予特别保护的传统,建国以前就通过颁布各项法律予以明确具体的规定;
建国以后,1979 年刑法在第一百八十一条就明确规定了破坏军婚罪,1997 年刑法在第
二百五十九条
