文档介绍：河北大学硕士学位论文破坏军婚罪问题研究及立法完善姓名:武妍申请学位级别:硕士专业:刑法学指导教师:孟庆华 2011-05 摘要 I 摘要军婚特殊保护法律制度是我国特有的法律制度,源自于我国的法律文化传统并在特定的历史时期发挥了相应的作用,体现了其存在之价值。本文考察了中国军婚特殊保护法律制度得以形成的历史背景及发展沿革,并阐释了破坏军婚罪的概念,对破坏军婚罪的构成要件进行了分析,明确在现行刑法二百五十九条的规定下,与军人配偶长期通奸的行为不构成本罪;破坏军人事实婚姻的行为应以本罪论处;而与有配偶的现役军人结婚或同居的人不构成本罪。破坏军婚罪属于继续犯,本文区别了破坏军婚罪与重婚罪、强奸罪等罪名的罪数关系。笔者建议对刑法第二百五十九条进行修改,增设与现役军人配偶长期通奸行为为危害行为;明确现役军人的配偶可以成为本罪的主体,与有配偶的现役军人结婚或者同居的人应成为本罪主体,以完善刑法对破坏军婚罪的规定。关键词军婚破坏军婚罪继续犯 Abstract II Abstract Military marriage protection legal system is China's unique legal system rootin our legal cultural tradition and in the specific hi storical periods, the corres ponding role play embodies the value of its existence.
