本文主要立足于历史文献,在前人研究的基础上,结合语言文字学材料,对
《尚书. 康浩》篇的著作时代和名称、关于该篇研究中的几个问题、“明德慎罚”
思想及其影响以及该篇中的法制思想及法制体系等几个方面进行了较为系统的
探讨。全文共分五个部分。
第一部分是引言。简要介绍了《尚书·康浩》篇的基本情况; 对前人研究《康
浩》的成果及存在的问题进行了简单述评; 指出了本文的选题意义、研究方法和
创新点。
第二部分对《康浩》的著作时代和名称进行考辨。这一部分在前人研究的基
础上,通过对成王说和武王说分别进行考察,认为该篇是成王时期周公封康叔于
卫的浩辞; 对康为溢号和康为地名二说进行了详细考察,认为康应为地名,并对
康地所处地理位置问题作了详细探析。
第三部分对关于《康浩》研究中的几个问题进行考察。本部分通过文献资料,
对该篇篇首四十八字错简问题、“王若曰”问题及其与《酒浩》、《梓材》的关系
问题进行了较为全面的考察,认为篇首四十八字确为错简,“王若曰”之“王”
实为周公,《康浩》、《酒浩》、《梓材》三篇实同一篇。
第四部分从“明德慎罚”思想的形成基础、内涵及影响三个方面进行考察,
对周初的“敬天保民”思想、“德”的内涵进行了详细论述,并对“明德慎罚”
思想的内涵及其影响进行了深入探析。
第五部分对《康浩》中的法制思想及法制体系进行考察。通过对该篇的仔细
研读及对历史文献的深入探析,本文详细地论述了该篇中的法制思想及体系,认
为其法制体系对后世有深远影响。并提出《康浩》中的法制虽然建立在君主专政
基础之上,但其对民众利益的保护具有时代的先进性。
