首都经济贸易大学硕士论文论我国旅游基本法立法的重要性
摘要
自 1990 年来,旅游业进入快速发展时期,并且逐渐发展为世界上最大的行业之
一。而我国旅游业实在改革开放之后才开始了逐步的发展。从旅游立法方面,从国务
院、国家旅游局到地方政府、地方旅游局等行政部门,都陆续颁布了相关法规政策,
对旅游发展起到一定规范和管理作用。但迄今为止,我国仍然没有建立起一套规范的
旅游法制体系。正是在这种背景下,我国应尽快出台“旅游法”。
除引言外,本文共分为五个部分
第一部分介绍了我国旅游业发展现状和旅游法的定义,从实际状况和经济发展的
需要介绍了旅游基本法急需出台的必要性。
第二部分阐述了我国旅游立法的发展历程及现阶段所存在的问题。重点分析了我
国旅游立法存在的诸多不足。
第三部分是对国外旅游立法实践的考察。由于篇幅、时间的限制,本文仅对《旅
游权利法案》及泰国旅游基本法进行研究。通过分析国外的旅游基本法的立法实践,
为我国“旅游基本法”的立法提供参考经验。
第四部分分析了我国制定“旅游法”的必要性和可行性。该部分详细分析了我国
“旅游法”缺位造成的不利影响、我国制定“旅游法”的必要性以及我国正式出台该
法律已经具备的条件三部分内容。
第五部分笔者提出了关于我国“旅游法”的几点思考。具体包括“旅游法”的名
称、“旅游法”立法原则、“旅游法”的调整范围。

ABSTRUCT
Since the 1990s, the tourism industry gets rapid development and es one of the
greatest industries in the world. After China reforms opening-up, the tourist industry has
achieved fast developments. However, the legal system concerned with tourism still falls
behind. Although the related governments have set up to some tourist laws and documents
that have contributed greatly to our tourist developments construction of tourist law has
some lagging.
The first part of this thesis research the ordinary category of Tourism Law. This part
analyzes the situation of the tourism world. And also analyzes the quality of Tourism Law,
the relation of Tourism Law.
The second part depicts the biggest problem on China’s Tourism Law’s legislation,
with concerned on the legal system focus with tourism still falls behind.
The third section is mainly about the research of Tourism Law abroad. For the limit of
the space, introduce the Tourism Bill of Rights, and the Tourism Law’s legislation of
Thailand. With the legislation of Tourism Law abroad, we can find lots of useful
information from it. And that behavior is effective to Tourism Law’s legislation of China.
