摘要
本文首先阐述了陪审员制度的历史变迁,指出我国人民陪审员制度属大陆法系
的“参审制”,是发挥人民群众参与国家管理,体现司法民主、推进民主政治建设
的基本保证,是人民法院审判工作坚持群众路线、实行合议制度的一种体现。但由
于立法和体制上的多种原因,我国人民陪审员制度的实施存在很多缺陷和问题。本
文从湖南省怀化市两级法院人民陪审员制度的实施情况进行总结、统计,列举了选
任的人民陪审员缺乏社会代表性,人民陪审员参审率低、参与度不高,参审的案件
类型单一,对人民陪审员缺乏规范化管理,人民陪审员经费难以保障等问题和困难,
在此基础上,作者提出了完善人民陪审制度的途径:1、明确人民陪审员制度的宪
法地位和适用范围;2、切实保障陪审员的基本权利;3、进一步完善人民陪审员的
管理制度。

Abstract
The people's jury system is the role of the masses to participate in national
administration, reflects the judicial democracy, promoting the building of the basic
guarantee of democratic politics is the people's courts of justice uphold the mass line, a
reflection of the implementation of collegiate system. However, due to a variety of
legislative and institutional reasons, the implementation of our people's jury system, there
are many ings and problems. In this paper, the Court of Huaihua, Hunan, two of
the people's jury system, the implementation of statistics and analysis, and the future of
how to improve our people's jury system put forward their own views and opinions。
