政府管理模式的研究

摘要

设计招投标是通过竞争寻求一个满意的合同相对方,招投标的本质
就是竞争。设计是工程建设的第一步,设计方案的好坏直接决定了项目
的成功与否,设计服务的优劣也是项目能否顺利进行的关键,在设计过
程中引入竞争机制,不但使得业主在比较中获得较优的实施方案,也促
进了设计专业技术水平的提高。更为重要的是,在政府和公共项目中,
设计合同也是政府采购的一项内容,采用招投标的采购方式,是政府采
购中竞争、公开、公平性原则的体现。
要有效解决招投标活动中存在的种种问题,建立和形成科学合理的
监督体系非常重要。靠目前现在政府一方单线式的监督模式是不完善的,
最大限度地提高招投标活动的透明度是保证公平竞争和防止“暗箱”操
作的最好办法。这就好比把整个招投标活动置入一个完全透明的“盒子”,
一切规则、内容、细节都公开“可供查验”,无论是招标人、投标人、代
理人、监管人、社会大众都可以加以监督并提出质疑。提倡“让大家来
共同监督”是一个值得推荐的改革思路,有利于维护市场优胜劣汰的公
平竞争秩序,形成良好的竞争氛围;有利于减轻政府工作压力、缓解政
府部门与招投标双方管理与被管理的长期矛盾,加大推行招投标制的力
度,真正实现“公开、公平、公正”的市场竞争原则。从另外一个角度
来看,透明度的增加也使管理部门的工作同时得到监督,督促管理人员
依法办事,减少管理的随意性。

MODE FOR ENGINEERING-DESIGN BIDDING AND
TENDERING IN SHANGHAI

ABSTRACT

Design bid is to seek for one satisfactory contract phase the other side
petition, the essence of bid is petition. The design is the
first step of engineering construction, quality of the design plan has
determined the eeding or not of the project directly, it is a key whether
the project could be carried on smoothly to design the quality served,
petition mechanism in the course of designing, not only make
owners obtain more excellent implementing scheme parison but also
promoted the improvement of the professional engineering level of designing.
The more important thing is, in the government and public project, the design
contract is a content of government procurement, the purchase way to adopt
bid is petition, embodiment of disclosing, and fairness principle in
government procurement.
Should solve all sorts of problems existing in bid activity effectively, it is
very important to set up and form the supervision system with rational
science. Lean against now government one party supervision one-way type
mode perfect at present, the transparency of improving the bid
