利益平衡视角下的高校电子资源知识产权法律保护研究
摘要
随着电子资源在人们获得知识和进行开发创造活动,以及在知识
传播过程中的作用变得越来越重要,对电子资源的立法保护也成为知
识产权的一个重要部分。电子资源的知识产权法律保护从无到有,从
最初的著作权保护到建立专有权利保护,从较小范围的保护限制到不
断扩充的保护限制,代表着对电子资源的法律保护的产生、发展和逐
渐调整以平衡所有权人专有利益和公众利益的过程。对电子资源的知
识产权法律保护的争议也由最初的是否应该保护、怎样进行保护逐渐
过渡到如何适度保护的问题。高等院校这一特殊公众群体,在知识创
造和知识传播中起着举足轻重的作用,但是其在利益获得上处于比较
弱势的地位,如果将其同其他公众群体等同视之,必将不利于知识的
创造和传播,从而引起社会公众的不满,事实证实也确实如此。因此,
如何在电子资源的知识产权法律保护中处理这一特定群体的利益和所
有权人的专有利益的平衡,在立法过程中需要进行特别注意。
本文首先对电子资源的概念进行了介绍,并在高校范围内进行了
界定;接着回顾了美国,欧盟,日本和中国现阶段的知识产权法律体
系的发展情况,及其对电子资源的知识产权保护的发展;然后将各个
国家对电子资源的知识产权保护进行了比较分析;然后重点分析了各
种利益冲突,并在实际的法律制度设计中分析了冲突状态的利益如何
进行取舍和协调以使其最终达到利益平衡状态。在分析的过程中,指
出了存在于现行的对高校电子资源的知识产权保护制度中的许多不尽
合理之处,并在最后,提出了相应的立法建议。

Abstract
With the greater importance of electronic resources to the process in which people
access the knowledge and do the creative activities as well as the dissemination of
knowledge, to enact legislation to protect the electronic resources has e an
important part of the Intellectual Property Rights (IPR) protection.
The IPR laws protection for electronic resources has gone through from absence to
establishment, from the original copyright protection to the establishment of exclusive
rights protection, and from small limits of the scope of the protection to expanding
restrictions on the protection, which indicates that the electronic resources IPR laws have
gone through legislation, development and the gradual rectifications which aims to
balance the proprietary interests of the owners and the public interests. And the disputes
that whether the electronic resources should be protected by IPR laws and how to protect
them have transferred to how to protect the electronic resources temperately. The
