文档介绍：华中科技大学硕士学位论文论新闻媒体和公众人物名誉权纠纷姓名:汪伟申请学位级别:硕士专业:传播学指导教师:孙旭培20050512I摘要西方法治国家司法实践普遍对公众人物名誉权进行弱化而我国有关公众人物名誉权的法理和司法实践尚处在摸索阶段舆论监督环境下的新闻媒体和公众人物名誉权纠纷是一个亟待研究和深化的课题本文首先把我国的公众人物划分为社会知名人士政府官员和企业法人三种类型并阐明其各自作为公众人物的适用标准接着分析新闻媒体与社会知名人士名誉权纠纷的发生原因并通过案例对新闻侵权案件的构成要件进行解读然后是分析媒体与政府官员名誉权纠纷问题首先提出我国司法实践应如何处理舆论监督下官员的名誉权指出官员名誉权弱化的理由高官无隐私以及新闻自由和官员名誉权的关系探讨我国官员应在何种程度上享有名誉权并指出媒体败诉的原因主要是我国法律对政府官员和普通公民不加区别地对待然后提出解决办法最后一个部分分析企业法人和新闻媒体的名誉权纠纷指出企业法人名誉权的实质是财产权指明企业法人的社会责任和法定义务并对媒体所面对的法律困境进行详细分析本文认为当公众人物的名誉权和言论出版自由权发生冲突时应优先强调言论和出版自由权对公众人物名誉权适当作弱化处理这既是宪法权利在民法理论上的具体体现也是维护社会主义社会公共利益的需要关键词公众人物名誉权知名人士政府官员企业法人IIAbstractWhen the dispute over the right of free speech and the right of private reputation ofpublic persons happens, as a fact, the right of free speech is prior to the latter in the legalstate. While in China, the jurisprudence law about public person is still in the stage ofdeveloping, at the same time, the lawsuits brought up by public persons ing moreand article begins with the classification of thepublic persons, that mean, Socialbrilliance, public officials and the enterprises. And, the author illustrate the condition thatwhen these three kinds of people are “public persons”. Combination with the illustrationof lawsuits, the article explains the reason why the collisionbetween social brilliance andthe media would happen, and, analyze the four-judicial-integrants of civil law in relationto media. In the next part of the article, the author would analyze the lawsuit between thepublic official and media. First of all, how to deal with the problem of the public official’s private right to reputation and the right of free speech under public surveillance, then, the reason that weakening the public official’s right to private reputation. After that, the author would explorethe relation of these two, and analyze in which degree that the publicofficial’s right to private reputation will work.
