It is the freedom of life with equality, and it is a basic right of modern citizen. Now the Constitution of most countries and many International Conventions all have such provisions, there were some constitutional practices in our history, but sooner after liberation, it was canceled because of the economical, political and ideological reasons, but there have no such right in our current Constitution. And this right is also limited by the system of household register. With the establishment and development of market economy in China, the person’s demands for the migration freedom es imperative day and day. Although a large number of papers about migration freedom can be found in china recently, but the discussion is plain, district the depth and development of research. The article from the law system’s point of view by utilizing the means of academic parative, analyzing the connotation of migration freedom, expounding the norm and practice, exploring the qualification and obstruction, and exploring the principle and choice of route. In author’s opinion, thoroughly realizing the liberty of movement is the request of market economy, is the request of keeping economy increasing and modernization, is the request of the equity of society, also is the request of the modern democracy and conforming to the International Convention. Therefore our Constitution should recover migration freedom early, and adopt to effective measures to guarantee this right.
