文档介绍:I摘要具有中国特色的劳动教养制度己经走过51年的凄风苦雨,其产生初期是为政治服务同时还可以稳定社会秩序的一种国家现实口径的办法,到现在弱化政治目的为社会治安大局服务成为一种行政处罚手段。我们不能否认这一制度在中国法制史上曾经起到过的积极作用。但由于推出之前准备仓促和规定的粗疏,尤其是程序规范的缺损,劳动教养制度在过渡和实施中也存在很多问题。近年来学者对这项制度提出了诸多批评意见,废除劳动教养制度的呼声与日俱增。但是任凭风吹浪打,劳教制度以其顽强的生命力、强大的处罚效能和力度站在诸种行政处罚的最前沿。事实证明劳教制度有其存在的价值基础,在控制复杂的社会局势、维护稳定、管理社会秩序方面有过人之处。让劳动教养一时间退出历史舞台是不符合中国实际的。本课题的目的即是对劳教制度的一些重大争议进行讨论,并对其改革完善提出一些构想。劳动教养制度的改革和完善应既维护社会治安局面又能实现尊重人权、保障人权,以实现司法公正。本文共分为四个部分:第一部分一般规定,介绍劳动教养制度的一般规定,从劳动教养的法律依据、适用范围、程序规定以及运作状况等各方面分析了劳动教养制度在现实法制体系中的地位、作用和运作情况。第二部分历史沿革,对我国劳动教养制度的创设和发展及完善进行了完整的阐述。充分论证了我国劳动教养制度的演化过程、指导理念和历史作用。第三部分实施缺陷,讲述劳动教养制度的实施状况以及法律、程序和法理上的缺陷和不足。第四部分改良改善,从实体和程序两个方面对劳动教养制度进行大胆的创新和改良,借鉴外国的保安处分措施中的合理成分,创建我国的《违法行为矫治法》以期建构一个既符合法治要求又符合我国国情的行为矫治制度,真正使劳动教养制度符合司法公正要求。第五部分结语。关键词:劳动教养矫治社会治安司法公正IIAbstractWith Chinese characteristics, re-education through labor system has been through 51 years of travel, initially produced for the service of politics as a function of both the resettlement policy provides that up to now the political purpose of weakening the overall situation of social security services as a means of administrative penalties .
