专利保护对行业技术创新的作用——以我国汽车工业为例

摘要
在世界经济日益全球化的今天,技术创新日益成为国家间竞争的焦点,伴随此
进程,专利制度已成为一种有效的国际通行的最重要的创新机制。在国际上,由于
一个健全的专利保护制度对于一国的经济增长和发展至关重要,因此,各国都加强
了对其的重视程度。中国将面对国际化的大市场,竞争格局将逐步升级,原来计划
经济下靠政府的计划分配技术资源显然不是最佳的资源配置方式。因而,研究专利
制度在我国技术创新中的作用,如何依靠和运用专利制度来激励、保护技术创新和
合法权益就显得尤为紧迫和重要。
本文先用产权理论分析了专利制度对知识生产的激励作用,然后将专利保护与
其他以奖励等形式来鼓励知识生产的措施进行比较,深入分析了专利制度在技术创
新中的作用。在陈述基础理论以后,本文对专利制度在现代市场经济中对技术创新
的作用进行了具体分析。在封闭经济条件下,对于不同的市场结构,专利制度发挥
的作用也不相同,一般而言,在完全竞争市场结构下专利对于技术创新的鼓励作用
最明显。在国际贸易条件下,专利制度更是起着“双刃剑”的作用,一方面专利制度
更有利国外技术的引进,可以产生技术扩散;另一方面又可能在某些高新科技领域
给本国企业在未来的进入时造成专利壁垒,阻碍本国的科技进程。
本文接着分析了在我国汽车工业的技术创新中专利制度所起的作用。我国专利
制度建立的时间不长,其形成也是源于国际贸易的持续发展使我国的专利保护不得
不与国外同步,否则就容易在贸易谈判中受到他国的抵制。总而言之,我国专利保
护使得汽车工业在技术引进方面获得更多机会,使得汽车工业从最初的完全技术引
进,逐步向模仿技术以至自主创新方向发展。在近年来,这一趋势表现得尤为明显。
因而,不能不说专利制度在我国汽车工业技术提升进程中起着重要的作用。

Abstract
Today, as the world economic globalization develops in depth, technological innovation
is increasingly ing the focus petition between countries. With this process,
the patent system has e an effective internationally recognized and the most
important innovation mechanism. Internationally a sound system of patent protection is
vital for the economic growth and development of a country, therefore, every country has
strengthened its attention on this. China will face the internationalized market and the
competition pattern will be gradually upgraded. The original planned economy under the
Government's plan on the allocation of technical resources is obviously not the best
allocation of resources. Thus, research on the role of patent system in our country’s
technological innovation, how to rely on and use the patent system to encourage and
protect technological innovation and legitimate rights and interests seems especially
pressing and important.
