二零零八年是中国改革开放三十周年, 也是工商行政管理恢复建制三十周
年。伴随着改革开放的伟大历史进程,工商行政管理事业也在不断发展壮大。三
十年来,工商行政管理在创建和维护市场经济秩序、促进产权制度多元化、引进
外商投资、保护商标权、保护消费者合法权益和营造公平交易和竞争的市场环境
方面发挥了重要作用。尤其是党的十四大以来,伴随着社会主义市场经济体制的
建立和完善,工商行政管理更是在完善市场体系,为市场机制发挥作用创造良好
的市场环境和弥补“市场缺陷”等方面发挥了难以替代的作用。
但是随着市场经济体制的发展,在这一过程中出现了新的问题,给工商行政
管理部门的工作带来新的挑战。在这一过程中,工商行政管理职能的转变并没有
跟上社会发展变化的步伐,加之产生并发展于计划经济体制条件下的工商行政管
理其职能任务、工作理念等方面还存在一些固有的惯性和弊端,使得现阶段的工
商行政管理职能作用还没有得到充分的发挥,因而承担着建立和维护市场秩序重
任的工商行政管理部门的地位受到不断挑战和质疑。
因此,结合我国政府行政改革的实际情况和工商行政管理的实践特点,从理
论和现实结合的高度,科学地界定工商行政管理的职能,认识和驾驭工商行政管
理的规律,对于持续发挥工商行政管理优势,避免工商行政管理职能边缘化,在
社会主义市场经济条件下发挥其职能优势,从而进一步推动工商行政管理事业发
展,具有特殊的意义。

Abstract

This year is the thirtieth anniversary of China's reform and opening, but also is the
thirtieth anniversary of administration for industry merce to restore it’s
establishment. Along with the reform and opening-up of the great historical process in
the past 30 years, the Administration for Industry merce make it’s
development and growth. Administration for Industry merce played an
important role in many fields, such as promotion of individual and private economic
development, the introduction of foreign investment, the protection of trademarks,
protect the legitimate rights and interests of consumers and create a market
environment for petition.
But with the development of market economy system, the administration for
industry merce facing a lot of challenges. In the process of system converting,
many problems of the administration for industry merce appears. Dislocation
of the functions of the errors in ultra offside and a number of non-rational
management activities, making the administration for industry merce
departments are facing "marginalization" situation.
Thus, from the theoretical and practical aspects bined with the actual
