城镇化进程中农地征用补偿机制问题研究

摘要
农地非农化的过程是农地资源重新配置和再利用的过程。随着我国经济和
社会发展向纵深阶段的持续推进,城镇化进程不断加快,非农用地需求不断增
加,越来越多的农民被动地失去了赖以生计保障和发展的土地,农民失地补偿
期望及实际生活状况与国家实行农地补偿的初衷存在较大的差距,因而一直无
法分享工业化、城镇化的发展成果。尽管各级政府已注意到这种状况并已经或
正在采取各种改进办法来改善农地征用补偿效果,但既没有形成统一的补偿机
制模式,又没有从根本上彻底解决被征农地利益相关方权益公平科学分配的问
题,特别是农民的权益依然没有被上升到市场经济快速发展背景下的高度予以
制度统筹安排和保护,因此造成的社会较深层次的问题仍然比较突出。使得农
地征用补偿问题成为了经济学界深度关注和热烈讨论的课题。
本文以城镇化理论、地租地价理论、产权理论为依据,采用定性和定量分
析、实证和规范分析等为研究方法,通过土地对农民的各种功能、失地后农民
面临的困境以及现行征地制度缺陷的分析,阐述了现阶段失地农民权益尚未得
以应有的体现的体制背景和原因。文章还研究分析了国外农地征用补偿的机制
和国内近年各地在农地补偿机制上不懈尝试的做法,借鉴并试图架构迎合市场
经济健康发展的农地征用补偿机制。

Abstract
Farmland expropriation is the process of relocation and utilization of
agricultural land resource. Along with the acceleration of economic
relationships and urbanization , construction land that converts from
rural land to urban land is increasing . At the same time , more and more
farmers had and would have lost their guarantees of employment and life ,
which land used to provide . There is a big gap between pensation
of farmers’ expecting and pensation of governments’ thinking . As
a result , peasants still haven’t enjoyed the progress of industrialization
and urbanization . Although governments have paid high attention to this
problem and are taking measures to pensation effects , a
unified model pensation mechanism hasn’t been formed . They are
the most important problems for the society that how to distribute the
interests and rights of the expropriated land and how to protect the
peasants’ rights in market economic mechanism .In economic circles , it
has been the noticeable and discussable theme to study farmland
expropriation.
Based on the urbanism theory ,land-rent and land-price theory ,and the
property rights theory , my discourse deeply sets forth the mechanism
backgrounds and courses of lost-land peasants’ damaged rights by the
