论知识产权滥用的反垄断法规制

摘要
在新世纪的知识经济时代,各国乃至国际反垄断立法都面临着一个重大的
课题,即如何规制知识产权领域的垄断行为。知识产权是法律赋予的一种合法
垄断权,一般是作为反垄断法的适用除外存在。但如果知识产权权利人超出法
律规定的正当范围,不正当地行使权利,非法限制竞争,从而违反了反垄断法,
对这种知识产权滥用行为必须进行规制。在世纪,企业之间、国家之间的竞
争从某种意义来说,越来越成为高科技的竞争。高科技往往以知识产权的形态
存在企业尤其是跨国公司,通过滥用知识产权来获取不正当利益已经成为常态,
如何规制知识产权滥用对处于发展中国家阶段的当代中国既具有理论意义,也
具有现实意义。本文基于知识产权和反垄断法的相关理论,从法律角度,借鉴
西方国家反垄断法律制度的最新成果,讨论了知识产权领域反垄断法律问题。
中心议题是知识产权滥用的反垄断法规制,并结合我国实际,分析了知识产权
滥用的反垄断规制的一系列基本问题,并提出了相关立法建议。
本文主要分四章进行讨论。第一章简单界定了知识产权及其性质和知识产
权滥用及其表现形式,分析了其与反垄断法的关系;第二章对目前世界上反垄
断法最发达的国家和区域美国、日本及欧盟的知识产权领域的反垄断法律规
范,进行了详细的考察,通过对国外知识产权领域反垄断规范的分析与比较,
以期为我国借鉴国外相关制度提供论证资料。第三章立足我国现状,分析了在
我国现有法律体系中,对知识产权滥用行为的规制的相关规定最后在第四章针
对现存的主要问题,提出了健全我国知识产权滥用的反垄断法律规范的若干建
议。

Abstract
In the new century the era of knowledge economy, national and international anti-monopoly
legislation and a major clinical issue, that is, how the field of intellectual property regulation of
monopolistic behavior. The law of intellectual property rights are a legitimate monopoly of power,
generally, except as the application of anti-monopoly law exist. However, if intellectual property
rights of people beyond the proper limits of the law, improper exercise of the rights of illegal
restriction petition, in violation of the anti-monopoly law, abuse of intellectual property
rights of this Regulation must be carried out. In the 21st century, between enterprises, the
competition between the country from a certain sense, e more and more high-tech
