《中国—东盟自由贸易区争端解决机制协议》评析

摘要

2002 年 11 月 4 日,朱镕基总理和东盟 10 国领导人共同签署了《中国—东盟全面经济合
作框架协议》,这标志着中国与东盟的经贸合作进入了一个新的历史阶段,为各国在法律框架
下进一步拓展经济合作的空间奠定了坚实的基础。随着双方贸易往来的增多,不可避免地会
产生贸易纠纷。要妥善处理在今后经济交往中双方间的贸易纠纷,有效地维护该自由贸易区
长足、有效的发展,建立其自身的争端解决机制是不可缺少的。2004 月 11 月 29 日《中国-
东盟自由贸易区争端解决机制协定》签署,并于 2005 年 1 月 1 日生效。CAFTA 争端解决机
制为该自由贸易区的运作提供了一个法律保障。笔者认为,为了能使 CAFTA 争端解决机制
在实践中更科学、更合理地解决纠纷,保障该自由贸易区的良好运作,更为迅速地促进双方
经济的发展,对 CAFTA 争端解决机制进行研究是十分必要的。在此同时,结合我国的国情,
作出相应的对策措施,使该争端解决机制能切实维护地我国的正当权益。
全文从以下四个方面来分析:1、分析 CAFTA 争端解决机制产生的背景;2、分析了
CAFTA 争端解决机制与世界上其他主要争端解决机制之间的异同。3、分析了 CAFTA 争端
解决机制利弊,并就如何完善该机制提出了几点建议。4、分析了 CAFTA 争端解决机制对
我国的影响及我国所应采取的法律对策。

Abstract
November 4 in 2002, Premier Zhu Rong ji and leaders of 10 ASEAN countries signed the
《China - ASEAN Framework Agreement prehensive Economic Cooperation》,which
marks the China-ASEAN economic and trade cooperation has entered a new historical stage. It
has laid a solid foundation for further development of economic co-operation for these countries.
With the incensement on trade, trade-disputes inevitably arise. We must properly handle in the
disputes of future economic and trade exchanges between the two sides. Thus effectively
safeguarding the free trade area by the establishment of its own dispute settlement mechanism is
indispensable. November 29, 2004, the enactment of 《 Agreement on Dispute Settlement
Mechanism of the Framework Agreement prehensive Economic Co-Operation Between
the Association of Southeast Asian Nations and the People’s Republic of China》for the Free Trade
Area provides a legal protection. Author believes that with the dispute settlement mechanism of
CAFTA to more scientific and more rational in practice, it will promote more rapid development
of bilateral economic .So, to study the dispute settlement mechanism of CAFTA is very essential.
