我国电信业消费者权益保护法律问题研究

摘要
本文从六个方面对我国电信消费者权益保护的法律问题进行了论述,即引
言、概述、电信业侵害消费者权益行为的表现形式及成因分析、香港及国外电
信业保护消费者的立法状况、我国电信消费者权益保护现状及其完善建议、结
论。在前言中,说明了撰写本文的目的和意义;在概述中,阐述了电信的概念
及我国电信消费者合法权益的内容;针对我国电信业侵害消费者权益行为,找
出了导致此类行为的原因(缺乏有效的竞争机制、法制不健全、政府管理不力、
电信企业服务意识差及人员素质不高、消费者弱势)并对此进行了分析;在第
四部分中列举了国外(如俄罗斯、澳大利亚、东南亚国家)及我国香港地区有
关电信业消费者保护的立法研究及其应用情况;在第五部分中,分析了我国电
信消费者权益保护现状,并在借鉴国外及我国香港地区先进立法经验的基础上,
对我国电信消费者权益保护从法律等角度提出了完善建议(如扩充电信消费者
的维权范围、改革解决电信消费纠纷的诉讼制度、建立消费者援助制度、遵循
“政府监管、企业自律、社会监督”相结合的监管原则、提高消费者的维权意
识及自我保护能力等); 在结束语中,对上述研究的问题进行了总结。

Abstract
There are 6 parts in the thesis, they are preface, introduction, the
present questions and cause analysis, the study and apply in abroad, the
perfect and conclusion. In the preface, it is illustration of the thesis’s aim
and sense; In the introduction, it concludes munication’s
conception and the consumer’s rights and interests in munication
in china. It is direction against the present of violating the consumer’s
rights and interests in munication, and find out the reasons(such
as lacking the petitive system and the law system ,
government’s management not strength ,staff’s quality not advanced, the
consumer’s influence weak and so on). There are all kinds of present
legislation stipulations in different countries (such as Russia, Australia,
Southeast Asia) in the forth part, and there is legislation research in
Hong kong. It perfects protecting our the consumer’s rights and interests
in munication based on other’s experience (such as enlarging the
range of the consumer’s rights, reforming the lawsuit’s system about
disputes in the consuming field of munication, establishing the
system of aiding consumer , following the principle of managed by
government , autonomied by enterprise and supervised
