摘要
由于民航业的高风险性,安全一直是民航领域强调的主题。在民航安全的特殊背景下,消费
者权益的保护让位于民航安全,而消费者也对此持默认态度。笔者通过对民航安全立法和消费者
权益保护立法的理念进行分析,得出结论:二者最终的依归都是保护民航消费者的权益,并不存
在根本的对立。保障民航安全也是对民航消费者权益的保护,不宜对民航安全强调过度,更不能
因此而牺牲民航消费者的权益。我们应寻求一种合理的平衡,在保障民航安全的基础上实现对民
航消费者权益的最大保护。
现实生活中,对民航安全的过度强调导致牺牲和侵犯民航消费者权益的案例时有发生。航班
延误、民航安检和不轨旅客这三个方面反映的问题尤为突出。航班延误中,出于免责考虑,航空
公司多用民航安全方面的延误理由来搪塞消费者,侵犯民航消费者知情权的同时也侵犯了求偿
权;民航安检中,由于安全检查的需要,民航消费者的隐私权和人身自由权缺乏保障;关于不轨
旅客,民航法授权机长全权处置。作为不轨旅客的这些消费者的人格权和安全权容易受到侵犯。
在对民航消费者权益保护的立法现状进行分析的基础上,笔者提出了法律制定层面的建议,
即从航班延误、民航安检和机长权力等方面完善相关法律规定;此外,在法律实施层面,加强民
用航空局、航空业自律组织以及民航消费者权益保护的民间组织的职能和功能。

ABSTRACT
Due to high risk of civil aviation, security has been emphasized in the field of civil aviation. In the
special background of aviation security, the protection of consumer rights gives way to civil aviation
security and consumers support tolerant attitude generally. After making legal analysis on the
legislative concept of aviation safety and consumers' rights protection, the author concluded that there
is no fundamental conflict and their final concurring is to protect civil aviation consumers' rights. To
guarantee civil aviation safety is to protect civil aviation consumers' rights. It’s unfavorable to
overemphasize the civil aviation safety or sacrifice civil aviation consumers' rights for this. We should
seek a reasonable balance to achieve maximum protection of civil aviation consumers' rights.
In reality, it has happened occasionally that the overemphasis on civil aviation safety leads to a
sacrifice and violation of civil aviation consumers' rights. Areas such as flight delays, security check
and unruly passengers present prominent dilemma that must be solved. In flight delays, airlines often
