我国失地农民养老保障建设中的政府责任定位研究

摘要
目前我国已经进入一个社会风险持续扩张的阶段,失地农民作为一个由政府行为产
生的特殊社会群体,其权益受到了严重的侵害,随着土地的征用,传统意义上的以土地
保障为核心的农民家庭养老保障模式的存续出现了危机,同时农村社会化的养老体系的
缺失,关键的改革措施不到位,再加上失地农民数量的庞大,使得他们成为种田无地,
就业无岗,社保无份的“三无人员”,因此如何妥善解决失地农民养老保障问题,完善
政府在制度建设中的责任日益重要。政府必须在这一过程中发挥应有的作用,建立失地
农民养老保障制度需要政府在政策制定与制度设计等方面给予指导,需要政府的全面介
入。
本文首先从城市化进程不断加快这一宏观背景出发,通过大量资料数据客观准确的
描述失地农民的现状,同时在阐述失地农民养老保障的重要作用的基础上,客观分析了
我国失地农民养老保障的现状。紧接着,文章从政府职能理论、弱势群体理论、构建和
谐社会理论等方面探讨了政府介入失地农民养老保障的理论基础,并对政府在失地农民
养老保障建设中的具体责任进行了界定。文章第三部分客观的描述了失地农民养老保障
建设中政府责任的现状,选取浙江、江苏、上海等城市为代表,重点分析目前政府介入
失地农民养老保障建设的责任模式,在此基础上指出各模式的优缺点。同时对失地农民
养老保障建设中政府责任存在的问题及原因进行分析。文章的最后结合各地的经济发展
实际情况,以及政府现阶段在失地农民养老保障中的责任现状,具体分析政府在失地农
民养老保障制度建设中的责任所在,并提出相应的完善对策:首先,强化政府在失地农
民养老保障建设中的立法责任,通过法律明确界定农村土地产权主体,加快失地农民养
老保障的立法建设;其次,完善政府在制度实施层面的责任,制定适应失地农民特点的
养老保障制度,改革现行土地征用制度,完善政府的激励约束制度;最后,加强政府在
失地农民养老保障建设中的财政责任,政府要加大对失地农民养老保障建设的财政投
入,同时建立有效的失地农民养老保障资金监管制度。

At present, China has entered a stage of continued expansion of social risk,land- expropriated
peasants as the special social group generated by the behavior of government,their rights suffered serious
the expropriation of land,land security as the core of a peasant family old-age security
