摘要
作为一项重要的民事法律制度,成年监护制度通过对缺乏自我保护和自我生
活能力的成年人进行监督或照顾来维护其合法权益,为行为能力欠缺的成年人实
现民事权利提供合法途径。当前,各国开始重视对被保护人人身的照顾以及本人
在日常生活中的自主决定权,从而建立起以充分尊重被监护人人权为核心的现代
监护制度。我国有关成年监护的立法主要见于《民法通则》之中,但囿于通则体
例自身及通则制定时社会生活条件与认识水平的局限,现行的成年监护制度难以
面对许多新现象的产生,也未与国外现代成年监护制度接轨。随着高龄化社会的
到来以及维护身心障碍者人权观念的深入人心,成年人监护制度的改革已势在必
行,关注他们的生存状况,维护他们的基本人权,对于保护私权与保持社会稳定
都具有重要的意义。
了解成年监护制度的形成与发展过程,理清其发展的脉络,对于我们深刻理
解成年监护制度具有重要的意义。国内外成年监护制度都经历了一个历史发展过
程,呈现出保护对象进一步扩大、财产管理与人身照顾并行、充分尊重受保护人
的意志的发展趋势。我国现行法律就成年监护制度的规定主要体现在《民法通则》
和最高人民法院《关于贯彻执行<民法通则>若干问题意见》的相关条文中,这些
规定构成了监护制度的基本内容。但由于当时社会条件及立法技术和理论研究的
落后,导致我国成年监护制度立法观念滞后、立法体例不科学、具体内容不足。
针对这些缺陷,应从理论观念的纳新、立法体例的完善以及制度内容的健全等三
个方面入手予以完善,创设新型的成年监护制度,以充分体现对被监护成年人的
人性关怀。

Abstract
As an important civil legal system, adult guardianship system through the lack of
self-protection and self-care for adults to supervise or care to safeguard their
legitimate rights and interests, the lack of capacity for the realization of the civil rights
of adults to provide legal means. Many countries have started paying attention to the
right for physical assistance and everyday self-decision making of the guardedness,
thus establishing a modern guardianship system with the sufficiently respecting the
rights of the gaudiness at its core. Our country see mainly concerning the legislation
of adult guardianship in the general rule of civil law, is but more limited than the style
self of general rule and the establishment of general rule social life condition and the
limitation of horizontal knowledge, current adult guardianship system is had to face a
lot of new phenomenon produce, nor with the foreign system into the modern adult
guardian. Along with longevity the arrival of society as well as the maintenance
