摘要

本文立足于保障未成年人权益,首先以现实生活中的未成年人监护所面临的
困境为切入点,发现我国未成年人监护制度立法现状之不足,由此提出国家公权
力直接介入监护制度的必要性。其次,通过比较与借鉴两大法系国家的未成年人
监护制度的立法经验,结合我国现实国情,提出设立国家监护制度的建议,并在
此基础上完善我国未成年人监护制度的具体内容。
本文包括四个部分。
第一部分概述国外及国内未成年人监护制度,包括监护制度的起源和近现代
监护制度公法化的发展。
第二部分评析我国未成年人监护制度的现状。首先,由发生的实际案例出发,
对我国未成年人监护面临的困境及其形成的原因进行分析;其次,对比不同国家
对未成年人监护的立法制度,发现当前我国现行的未成年人监护制度之不足;最
后,在顺应世界各国监护制度公法化发展的潮流下,呼吁国家公权力对我国未成
年人的监护进行有效干预,建立国家监护制度。
第三部分是分析国家监护制度在我国建立的必要性及现实基础,为未成年人
国家监护制度的设立提供有力的理论依据。
第四部分是对我国未成年人监护制度的完善提出相关建议,主要是提出设立
国家监护制度的设想,包括国家监护的制度层次以及制度实现的阶段设计两个方
面。并在此基础之上,建议对未成年人监护制度的具体内容进行补充完善,形成
较完备的未成年人监护制度体系。

ABSTRACT

This article is based on safeguard for the minor's legitimate rights and interests;
first of all, taking the pointcut of the dilemma that the minor guardianship faced in the
real life, we found the shortage of the statute of the minor guardianship legislative
system, therefore, puts forward the necessarily of state power directly involved in the
minor guardianship system. Secondly, through contrast and use of the experience the
statute of the minor guardianship legislative system of two legal civil law countries,
combine the current realistic of China; propose suggestions to build-up guardianship
system and to perfect the specific contents of State minor guardianship system in that
basis.
