现代刑事诉讼强调打击犯罪与保障人权的统一,由于供述制度本身
所具有的权利和权力冲突的特点,不同的供述制度选择代表了各自不同
的价值取向。随着我国法治的推进,刑事诉讼理念的进步,如何完善供
述制度越来越为人们所关注,特别是,由于刑讯逼供导致的一些冤假错
案的披露,遂使沉默权和如实供述义务问题成为了学者探讨的焦点。本
文从供述制度中权利和权力冲突的原因分析入手,对如实供述义务和沉
默权进行比较,借鉴当前沉默权的变革趋势,同时对中国目前如实供述
义务制度存在的不足进行分析论证并提出解决方案,旨在坚持如实供述
制度的前提下,寻找到供述中的权利和权力冲突的衡平。

Abstract
Criminal proceedings against the modern emphasis on the unity of crime
and protection of human rights, the statement by the system itself conflict
with the rights and powers of the characteristics of the different choice of
system on behalf of their respective statements different values. With the
advancement of the rule of law, the concept of criminal proceedings progress,
and how to improve the system more and more statements of concern for
people, especially, due to torture led to the disclosure of some trumped-up of
tension, the right to remain silent and be a true account of obligations the
scholars of the focus. From the statement of rights and power system, the
reasons for analyzing the conflict, and the right to remain silent on the true
account of obligations pare, learn the current trends of change right to
remain silent, while China is a true account of obligations to analyze the
ings of the system and propose solutions demonstrated to adhere to
the true account of the system under the premise of finding Confessions of
equitable rights and powers of the conflict.
